Terms of Service for Evenly Money

Evenly Money is displayed on your Home Screen as Evenly. These terms govern your use of the app, website, and related services provided by Hardik Pakhale.

1. Agreement and Service

By downloading, accessing, or using Evenly, you agree to these Terms. If you do not agree, do not use the service.

Evenly helps users budget, save, split expenses, track subscriptions, manage shared balances, and settle up. Evenly is not a bank, payment processor, lender, broker, accountant, tax advisor, financial advisor, or debt collector. Evenly does not hold funds, move money, collect debts, or guarantee payment between users.

2. Eligibility

You must be at least 13 years old, or the minimum digital-consent age in your country if higher, to use Evenly. If you are under the age of majority where you live, your parent or legal guardian must review and consent to these Terms and the Privacy Policy.

Users in the EU, UK, or EEA must meet the applicable age of digital consent in their country, which may be 16 unless local law allows a lower age. Bank linking through Plaid is available only to users who are at least 18 years old and legally able to connect a financial account.

3. Account Security

You agree to provide accurate account information, keep credentials secure, and notify us if you suspect unauthorized access. You may not impersonate another person, create accounts for abuse, share an account in a way that compromises security, or use Evenly if legally barred from doing so.

You are responsible for making sure your use of Evenly is allowed where you live and under any bank, card, payment-app, employer, school, family, or group rules that apply to you.

4. User Content and Shared Data

You retain ownership of expense data, notes, receipts, descriptions, group details, profile information, and other content you submit. You grant us a limited license to host, store, process, display, transmit, and use that content as needed to provide, secure, support, and improve Evenly.

When you add content to a shared group, subscription, expense, settlement, invite, or similar feature, other participants may see, export, save, or rely on that content. You are responsible for making sure your content is accurate, lawful, and shareable.

5. Acceptable Use

  • Do not use Evenly for fraud, harassment, abuse, illegal activity, unauthorized commercial activity, or unlawful debt collection.
  • Do not submit false, misleading, unlawful, infringing, or harmful content.
  • Do not access another user's account or data without permission.
  • Do not interfere with, overload, scrape, reverse engineer, or disrupt the service.
  • Do not violate third-party terms, including bank, payment-app, Apple, Google, Firebase, or Plaid terms.

6. Financial Features and Accuracy

Evenly provides calculations, estimates, suggestions, and organizational tools. Expense splits, balances, budgets, safe-to-spend amounts, savings projections, subscription insights, currency conversions, receipt scans, imported transactions, duplicate detection, and settlement suggestions may be incomplete, delayed, inaccurate, or based on information you entered incorrectly.

You should independently verify important financial information with your bank, payment app, card issuer, or other authoritative source. Evenly does not provide financial, legal, accounting, or tax advice.

7. Payments and Plaid

Evenly does not process payments or transfer money. Actual payment activity happens outside Evenly and is governed by the third-party payment provider's terms.

Plaid bank linking is optional and read-only. Evenly cannot initiate bank transfers through Plaid. By connecting a bank account, you authorize Evenly and Plaid to access and transmit account and transaction information needed for Evenly features.

Bank data may be delayed, incomplete, categorized differently by Plaid or your institution, or unavailable during provider outages. Evenly is not responsible for bank-provider errors, account restrictions, institution outages, Plaid outages, or decisions your financial institution makes.

8. Future Subscriptions and In-App Purchases

Evenly may offer paid features, subscriptions, trials, or other in-app purchases in the future. If offered through Apple's App Store, pricing, trial details, renewal terms, and cancellation instructions will be shown before purchase. Subscriptions may renew automatically unless canceled under Apple's rules. You can manage or cancel App Store subscriptions through your Apple ID settings, and refund requests for App Store purchases are handled by Apple unless applicable law requires otherwise.

9. Third-Party Services

Evenly may use or link to Apple services, Firebase/Google Cloud, Plaid, Google Sign-In, currency-rate providers, website hosting/security providers, and external payment apps. Third-party services are not controlled by Evenly, and their own terms and privacy policies apply.

10. Intellectual Property

Evenly, including its software, design, logos, trademarks, interfaces, and non-user content, is owned by us or our licensors. You receive a limited, revocable, non-exclusive, non-transferable license to use Evenly for personal use under these Terms.

You represent that you are not located in a country or region subject to a U.S. government embargo, are not on a U.S. government restricted-party list, and will comply with applicable export-control and sanctions laws.

11. Privacy and Account Deletion

Your use of Evenly is governed by our Privacy Policy. You may delete your account in the app where supported. Shared records needed by other participants may remain, although your personal identity should be deleted, removed, or anonymized where appropriate.

12. Disclaimers and Liability

Evenly is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.

To the maximum extent permitted by law, Evenly and Hardik Pakhale will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, financial losses, user disputes, third-party failures, service interruptions, or reliance on estimates or calculations. Our total liability for claims related to Evenly will not exceed the greater of $100 USD or the amount you paid us for Evenly in the 12 months before the claim.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Evenly and Hardik Pakhale from claims, damages, losses, liabilities, and expenses arising from your content, misuse of Evenly, violation of these Terms, violation of law, or disputes with other users.

14. Changes, Law, and Disputes

We may update these Terms from time to time. If changes are material, we will provide notice through the app, website, email, release notes, or another appropriate method. Your continued use after the effective date means you accept the updated Terms.

These Terms are governed by the laws of Texas, United States, except where local consumer-protection laws require otherwise. Before filing a claim, contact evenlyapp.help@gmail.com so we can try to resolve the issue informally. Users in the EU, UK, EEA, or other jurisdictions with mandatory consumer protections retain any rights and forums that local law requires.

15. Apple App Store Terms

If you downloaded Evenly from Apple's App Store, Apple's terms also apply. These Terms are between you and us, not Apple. We are responsible for Evenly and its content, maintenance, and support only as stated in these Terms and applicable law. Apple is not responsible for Evenly's content, maintenance, support, warranty claims, product claims, intellectual-property claims, or third-party disputes except as required by Apple's applicable terms. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it.
